Biltmore Lake Annexation Update 

IMPORTANT NEWS:

·        NORTH CAROLINA CITIES'� LAWSUIT SEEKING TO OVERTURN PETITION PROCESS  

Reported at the 11/29/11 Annual Homeowner�s Meeting was the issue of timing regarding the Board of Elections certification of the annexation denial petitions and the date of the Biltmore Lake hearing at the Appellate Court on December 15, 2011. 

 

In our case, per annexation law, the BOE has until December 16, 2011 to certify the count of the denial petitions.   It is certainly possible the BOE will have completed their work prior to 12/16/11.   However, the Asheville City Attorney has stated the city will not �give up� any right it has to challenge the count or, for that matter, any other legal right in regards to the overall petition process through the 12/16/11 date.   

By overwhelming response, regardless of the timing of the certification of petitions, the residents at the Homeowner�s meeting gave authorization to proceed with the December 15th appeals hearing and expenditure of funds to assure our attorney presents oral arguments in Raleigh.  Although confident the count will confirm the return of the necessary 60% of petitions to deny annexation, it was decided not showing for the appeal hearing may surrender our legal rights going forward.  Having come this far, it is important to keep open all channels to fight forced annexation.  

Following the decision to proceed with the Appellate Court hearing, a suggestion was made to begin the effort to raise the necessary funds to pay the cost of such action.  At the meeting, many residents pledged an additional $200 to help fund this expense.  BLCAC Treasurer Dieter Buehler is accepting checks now.  Your financial support is necessary to meet this objective.  

Predicated upon the news that a number of cities are disputing the legality of the petition process, it is difficult to determine the impact this may have on our community or the cost of our involvement in a legal battle in this regard.  We wi�ll keep you abreast of this latest development.

Here at the eleventh hour, just before the various County Board of Elections are suppose to conduct the official tally of the petitions-to-deny-annexation, the cities of Lexington, Kinston, Wilmington, Goldsboro and Fayetteville have joined together to file a lawsuit seeking to overturn the petition process. The city of Rocky Mount has filed an independent suit for the same purpose. The good news is the cities had asked for a temporary restraining order to stop the Election Boards from conducting their respective tally but Judge William Pittman refused to grant the restraint. (Video on News14) But on 15 December in Wake County Superior Court (Raleigh) a preliminary injunction hearing will be held to consider preventing the Boards of Elections from certifying the petition count. 

This will be an important hearing that you should consider attending. The Superior Court is held in the Wake County Courthouse building in the 300 block of Fayetteville St, (within the 5th block directly south of the General Assembly.) Time of day is unknown right now. 

If you cannot attend please consider contacting (call AND write) any and all legislators to urge them to pass a moratorium bill. The cities have decided to play hardball so it is now time for a moratorium on all annexations. 

The irony in these suits brought by the cities is their principle argument is that ALL the annexation legislation, even the overarching Annexation Reform Act of 2011, passed by the most recent General Assembly is unconstitutional because all city residents are not given the opportunity to vote! What a twist for the cities to now be concerned about voters rights! 

I personally believe the cities might have a case IF: 1) the petition process was a vote?it is not or 2) if the process involved �voting� someone into office?it does not. It may be tempting then to think the cities do not have a chance of winning but there is often little rhyme or reasoning to judicial judgment and since there is so much at stake, we at FAC encourage you to act. 

Lastly, it has been recommended by supporting legislators that the forced-annexation opponents obtain legal counsel to represent our interest in court. Leaders of the various citizen groups involved will be working together in the next few days to make this happen.

*** Congratulations -- 90% ***  

We have reached our 90% goal for returned annexation denial petitions.   

Special thanks to the volunteer patrols and, of course, sincere thanks to all Biltmore Lake residents who signed and returned their denial petitions.   

Now, in accordance with the new law, we will wait until mid December 2011 to learn the �official� count but with a full 30% beyond the required percentage to deny annexation we have resoundingly demonstrated our opposition to FORCED ANNEXATION.

Biltmore Lake Annexation Update 

A significant effort to help bring awareness regarding the ability for property owners to deny forced annexation has been successful.

 We are happy to acknowledge and offer many thanks to all the volunteers who were essential to our success.  They went above and beyond the call of duty to find some of our residents.  Margie Zack drove across town to find one of our non-resident owners and then found an empty house when she arrived.  She called the number on the for-sale sign and found the owner!  Nelson Sartoris helped three other volunteers when he finished his list and was instrumental in contacting many of these residents.  And Jamie Turner through his extensive network of friends, clients and associates, was able to uncover more �votes� than any other single volunteer.

It is encouraging following only four weeks of activity, thanks to the Biltmore Lake property owners targeted for annexation and all of these volunteers, the following �unofficial count� can be reported: 394 denial petitions returned = 85%.   

The Steering Group and the �foot patrol� volunteers know there still are property owners who have yet to return their petition but are planning to do so.  We are getting much closer to the 90% goal so we encourage those who have yet to return their petition to please do so soon.

Biltmore Lake Annexation Update
 
It is incredible what can happen in two weeks.  Thanks to you, the �unofficial� count of returned annexation denial petitions is --317 which represents 68%.  And, we have an additional 116 days to further demonstrate our resolve against forced annexation.  Our 90% goal is attainable.  To reach that level we are counting on you, so please return that petition. 
 
Biltmore Lake neighbors have further demonstrated their commitment to right a wrong.  Forced Annexation is not right.  Given the opportunity to vote, overwhelmingly the choice is now clear. � We do not need nor want Asheville�'s governance. 
 
We� will have to wait until mid December 2011 to learn the actual and final tally of the petition count to stop annexation.  But, you might find this interesting?...had Biltmore Lake neighbors not banded together to oppose forced annexation, our community would have been annexed in Dec 2007.  Perseverance most often pays off, and in our case it took 5 years.  Come December we will stand-tall knowing '�you can fight city hall'� and win.

Biltmore Lake Annexation Update 

We�re on our way!  A large number of BL residential property owners have reported returning their petitions.  Returned as well are the 44 denial petitions for parcels titled to the Biltmore Lake Association for common land (trails, clubhouse, etc.).    

The new law requires petition returns of 60% to stop annexation.  With pleasure, we are happy to report this first week, we are nearly half the way there. We have a ways to go, but think how exciting it will be when we actually exceed the BL 90% goal for returned petitions.  We need a solid commitment to reach these goals, so please don�t delay acting on this important �new right� of voting your choice against forced annexation.  If we squeak by with barely 60%, we can almost be assured the city of Asheville will come after us again in three years.  So, if you don't want to be burdened by additional taxes with no additional services and plenty of new regulations, please return your petition and encourage your neighbors to do as well; and, let's send a strong message to the city to not try this again.   

Instructions printed on the petition state you may return your petition in person to the BOE office or return it via the US Mail in the addressed envelope included with the petition.  You are encouraged to do so immediately.  It is recommended each property owner maintain a photo copy of their signed, returned petition.   

Biltmore Lake volunteer neighborhood foot-patrols have been dispatched canvassing door-to-door to help answer questions property owners may have as well as asking everyone to inform us when they return their petitions.  To keep track of our progress, when you send in your petition, you are urged to please contact:

Annexation denial petition letters were mailed to affected Biltmore Lake property owners Friday � July 22, 2011.  Some residents have reported they have already received their letter, nonetheless, if you have not, you should receive your letter/petition not later than Monday or Tuesday -- please do not lose it or throw it away.  

A properly signed petition MUST be returned to the Board of Elections to be counted to reach the 60% level necessary to deny annexation.  Please be aware all petitions not returned will count as a YES vote FOR annexation.

Biltmore Lake Annexation Update

Beginning this week (July 18, 2011), the County Board of Elections will mail annexation denial petition letters to those Biltmore Lake property owners including the Enka Village residents living on Lake Drive and Hillcrest affected by the proposed annexation.  Although we have asked for an advanced sample-copy and the specific mail date, we are unaware at this time when the mailings will occur. Nonetheless, please look for a letter from the Buncombe County Board of Elections and please do not lose or discard that letter. 

A properly signed petition MUST be returned to the Board of Elections in order to count as one of those necessary to reach the 60% level to deny annexation.  Please be aware all petitions not returned will count as a YES vote FOR annexation.  Therefore, it is critically important for all property owners to sign and return their petition. 

The Board of Elections will not include an envelope in which to return your petition.  Nevertheless, you can sign the petition and mail it to the election board or hand-deliver it to their office. Additionally, the Steering Group is proposing two additional options. We are exploring the possibility for property owners to drop off their signed petition at the clubhouse at a designated time (for example 2:00 PM to 7:00 PM) on a given date (TBD) for collection and to be hand delivered en masse to the election board.  In conjunction with this, another potential option is to call Beth Gurnack (670-1423), who heads up a group of BL volunteers willing to come by your home and pick up the signed petition. 

Although the law allows 130 days for petitions to be returned, we believe to wait is folly.  A strongly united community should overwhelmingly demonstrate their resolve by returning denial petitions within 30 days.  This amount of time (30 days) will afford those property owners with out-of-town mailing addresses to receive their letter/petition, sign it and return the petition as quickly as possible.  

Believing it is important to send a clear and resounding statement to the city of Asheville regarding forced annexation; our goal is not just the necessary 60%.  We believe our goal to deny annexation should be at least 90%, and as best as is possible to keep track of the returned petitions, we are asking your cooperation to inform either Dieter Buehler (665-7290 dbuehler38@gmail.com ) or Mary Lou Sartoris (665-0407 marylousartoris@charter.net ) when you have signed and returned your petition.  With this tally, we can help determine progress toward the goal.  Please note, even if you were unable to contribute to the legal fund, it is important to sign and return your petition.

Your no vote will save all Biltmore Lake residents thousands of additional dollars in taxes and keep us from having to comply with the additional burdens of living in the city of Asheville.  At this stage, returning your denial petition remains one of the single most important things you can do for your family and your neighbors.

Biltmore Lake Annexation Update 

House Bill 845 - the 2011 Annexation Reform Bill - becomes law

effective midnight 6/30/2011. 

Following passage in the General Assembly, this historic legislation was sent to the Governor for signature.  Governor Perdue did not endorse the bill; instead allowed it to become law without her signature.   

H 845 was the culmination of the tireless efforts of many citizens across the state.  Thanks to all of you who called or emailed the legislators in support of this reform.  The text of this bill provides detail of the annexation law with the many reform changes.

One of the primary changes afforded by H 845 is the ability of those threatened with forced annexation to sign a petition denying that annexation.  This 'voice' of the people is once again possible after being absent from North Carolina law for over 50 years.  

In addition to H 845, as most of you know, House Bill 56, which directly affects Biltmore Lake, has been enacted.  The details of the 'petition process', similar to that of H 845 are spelled out, but questions remain.  Note the effective date of HB 56 was June 18th; the county tax assessor has 30 days (due July 18) to prepare a list of the real property parcels within the proposed area to be annexed and forward such list to the board of elections who will prepare petitions for the real property owners to sign opposing the annexation ordinance.  The board of elections will accept signatures until 130 days after mailing the petitions.   

Suffice to say, there will be considerable follow-up work required to make sure all affected residents are up to speed and do their part to correctly complete and return their part of the petition.  We will be looking for volunteers to help with this effort. 

As soon as answers regarding the petition procedures are available, the Steering Group will conduct an informational meeting and a Q&A session.

Good News for Annexation Reform Proponents 

House Bill 56 has been ratified and will become law.

Per this new law, the Biltmore Lake annexation will be suspended pending the outcome of a petition protest to be conducted in accordance with the requirements of this bill.  Mr. Craig Justus, our attorney, has been asked to engage the City Attorney relative to a �stay� of the appeal process. 

As you read H 56, no doubt questions will come to mind.  The details of a petition to deny annexation are spelled out but there is need for greater clarification and process definition.  Recall not all homes presently built within the Biltmore Lake community existed back on May 22, 2007 when the annexation attempt began.  And, there have been sales of homes within the annexation boundary area and these new owners will be eligible to sign the protest petition, etc.  These elements and others will be addressed and clarified so we can be certain to obtain the 60% of property owner�s signatures for denial of the forced annexation.

The Senate Finance Committee is scheduled to vote on the 2011 Annexation Reform Bill (H845) tomorrow afternoon 6/14/2011 at their 1:00 PM meeting.  Following a positive vote by the Finance Committee, the bill will go to the Senate floor for deliberation and a vote.  It is critically important to let ALL Senators know your desire for passage of annexation reform.  H 845 establishes the right for homeowners - confronted with forced annexation - to sign a petition opposing that annexation.

Measure would let homeowners veto hostile annexation attempts

RALEIGH � Historic annexation reform legislation is on the verge of passing before the 2011 session of the General Assembly adjourns. House Bill 845, which could become law in the next few weeks, would reverse a 50-year-old policy silencing residents who face being annexed into cities against their consent. Even so, some say the bill doesn�t go far enough.

The Annexation Reform Act of 2011 would accomplish two major goals. It would give property owners targeted for forced annexation an opportunity to reject or �veto� the annexation, and force cities to provide meaningful services � including water and sewer � to those being annexed at no cost other than regular service charges.

The bill is unusual in that it has the support of the state�s grass-roots annexation reform groups while not being opposed vocally by the powerful North Carolina League of Municipalities. The league has remained on the sidelines because reformers are holding back a measure declaring a moratorium on all annexation proceedings for the next year. Reformers believe the moratorium is a trump card they will play only if needed.

H.B. 845 passed the House by a 107-9 landslide in May and is expected to glide through the Senate, where Republicans have a veto-proof majority. And �God help� Gov. Bev Perdue if she vetoes it, supporters say.

What the bill does

The single most important reform in the bill gives property owners a voice, said Daren Bakst, director of legal and regulatory studies for the John Locke Foundation.

Since involuntary annexation became legal in North Carolina in 1959, rural property owners have had little recourse when a city decided it wanted to take them in. They were forced to live under city rules and pay city taxes for services many neither wanted nor needed.

The reform bill offers property owners a chance to �veto� a city-initiated annexation if 60 percent of them sign petitions rejecting the annexation.

Some activists argue that the onus should not be on annexation opponents to reject the annexation. Instead, they say, 60 percent of property owners should be required to approve an annexation before it goes through.

But it�s a burden Cathy Heath, co-director of the Stop NC Annexation Coalition, is willing to bear. Based on her experience fighting forced annexation, getting petitions signed and mailed by 60 percent of targeted property owners should be no problem.

�They kick into gear, they get organized, and they�re highly motivated,� Heath said. �They�ve gathered petition signatures from way more than 60 percent time and time again, and that�s when the petition was nothing more than a statement that didn�t have any weight of law.�

H.B. 845 a big step in the right direction, Bakst said. �Considering for 52 years this state has not given property owners any voice at all, to actually have a voice now is huge.�

The second most important reform the bill makes, Bakst said, is that it requires cities to provide water and sewer lines to annexed neighborhoods at no cost to the property owners.

Cities often argue they need to annex a group of property owners in order to �save them� from their failing septic systems, and then fail to provide water and sewer services in a timely manner after the annexation is complete. And when the lines are built to the annexed community, property owners get the bill, which can amount to tens of thousands of dollars per homeowner.

Bakst said the cost of providing �free� water and sewer lines alone may be enough to deter cities from attempting a forced annexation.

What the bill doesn�t do

Some reform activists object that H.B. 845 does nothing for communities that already face forced annexation or that currently are in court fighting an annexation proceeding.

Keith Bost, who lives in Sapona, a golf-course community just outside Lexington, is incensed. Sapona residents are in court fighting what they call an improper and illegal annexation by Lexington. Bost says his neighbors face long odds, as courts typically side with cities in legal actions against annexation. He was hoping the reform bill would be retroactive, letting it apply to communities now in litigation or recently annexed.

Heath said she would have preferred making the bill retroactive as well, but doing so would decrease significantly its chances of passage.

There also has been talk of including a provision exempting farms from involuntary annexation. The petition process alone is not enough to protect farms from annexation, Heath said, because a farmer could get stuck with a group of property owners who actually wanted to be annexed and be outvoted.

This addition also would decrease the bill�s chance of passage. The goal, Heath said, is to break annexation reform into smaller bills that the League of Municipalities can accept, one at a time. Trying to overturn the whole system in one bill would be futile, she said, as the league, which has lots of friends in the legislature, would never let it pass.

Right now, the reform bill is the most important thing, Heath added. Activists are sitting on House Bill 9, which would nullify all annexations now in litigation, as leverage to make sure H.B. 845 becomes law.

After the reform bill is passed, Heath said, Republican lawmakers have promised to do everything in their power to pass a series of local bills designed to rescue communities in litigation and even to reverse some recent annexation proceedings.

Heath added that Rep. George Cleveland, R-Onslow, has promised to take care of farmers with a separate measure, House Bill 168, exempting them from annexation, extraterritorial jurisdiction, and city zoning ordinances.

H.B. 845 now sits in the Senate Finance Committee. With the passage of the budget, Senate President Pro Tem Phil Berger, R-Rockingham, has assured annexation reform groups that the bill will be a top priority.

Well time flies. It has been almost two weeks since that happy evening when HB 845 passed its third reading in the House and was sent to the Senate. Please hang in there with me on this rather long burst. It has been ALMOST three months since our first local bills passed the House and went to the Senate Rules Committee.

Here is a recap of those bills:

HB 5 Kinston Annexation Repealed has been in the Senate Rules Committee since 03/03/11.

HB 37 Lexington Annexations Repealed has likewise been in Senate Rules Committee since 03/03/11.

HB 56 Rocky Mount Annexation Repealed went to the Senate Rules Committee on 04/05/11 and then to Senate Finance Committee on 04/26/11 -- more than a month ago.

HB 180 Wilmington Annexation Suspension, went to the Senate Rules Committee on 04/05/11.

HB 196 Goldsboro Deannexation was voted favorably out of the Government Committee and has been in the House Finance Committee since 03/24/11.

HB 231 Fayetteville's Gates Four Annexation Repealed has also been stuck in House Finance since 03/17/11.

HB 236 Biltmore Lake Annexation Repealed has been in the Senate Rules Committee since 04/05/11.

There have been many phone calls and e-mails from many of us asking what the heck the hold up is on all these bills. Most of those requests for information have gone unanswered.

Let me share with you what I DO know:
1. Representative Stephen LaRoque has given a little insight into the handling of the above bills when he told those citizens under the gun of a quick annexation by Southport:
"I have already asked Jerry Cohen to start preparing the PCS for HB-5 that will include the Repeal of several annexations and I will include the Southport annexation if they pass their Ordinance prior to HB-845 becoming law."

Now that is being proactive. Representative LaRoque has been working closely with Representative Frank Iller, Brunswick County, on this annexation.
2.
Senator Buck Newton told Charlene Moore, OLCAFA President, that the Senate will not be doing anything next week with the annexation bills because of THE BUDGET.  He did tell her the plan is still to use HB56 as the main bill to include all of the other annexation repeal bills.  The plan is to write it just like HB845 to give the citizens a petition vote on the annexation.  He told Charlene he was going to take care of HB56 before he goes home this year.
3.
Representative Tim Moffitt told me Friday that "...I and others are still working with Senate staff on drafting amendments that can hopefully be added to 845.  I currently have the two in front of them and will complete my additional two this weekend for them to consider.Additionally, Stephen (LaRoque) has almost completed the repeal bill that will allow all of our original work to go forward.  My best guess for all of us is that 845 will be addressed during the week of June 5th in the Senate."

Thanks to those elected officials who have shared that information with us.

Speaking of sharing, folks, I share your frustration. Many of you have eloquently written me expressing your frustration. We see other bills being handled on a daily basis in the Senate, yet minimal action on annexation reform. Our bills have stagnated.

I believe all of us have been very, very patient. We also recall vividly how the former Senate leaders took obvious glee in releasing their little s***bird to rain "do-do" on our hopes. We know that this "bird" no longer resides on Jones Street, yet it seems our Senators do not realize how patient we have been and how CRITICAL the timing is for the folks in Davidson, Nash, Buncombe, Cumberland, and Brunswick Counties due to impending legal rulings.

In addition, the deadline for a bill to make cross over approaches -- rapidly, and new Goldsboro residents in Wayne County need to get their bill out of House Finance ASAP. The same holds true for the Gates Four legislation.

So, I am asking that you call and e-mail the following House leaders to move on HB 196 Goldsboro Deannexation and HB 231 Fayetteville's Gates Four Annexation Repealed. Get them out of House Finance and voted on and moved to the Senate.

The annexation reform bill (HB845 - Annexation Reform (LaRoque, Dollar, Owens)) is expected to be heard in the Senate Finance Committee within the next two weeks. League staff is continuing discussions with various legislators to ensure the bill does not worsen. The two main provisions � free water and sewer connections all the way to the home and a petition allowing a veto by the owners of 60% of the annexed properties � will already severely restrict annexations in the state, making growth in many areas impossible...

House Bill 845 - Annexation Reform Act of 2011, passed the Second Reading on the House Floor today!

The Bill passed by vote of 102 for H845, and 13 voting against H845.
As Speaker, Thom Tillis did not vote on H845.

H845 will now be on the House Floor Calendar for Monday evening for it's third and final reading. This will be the final House vote to pass H845 on the House side.

H845 will be sent to the Senate for consideration after the vote on Monday.
The Senate is expected to thoroughly review the provisions of H845 and move it quickly to passage. Additional Legislation regarding forced annexation is also expected to be brought forward in Senate.

H845 gives those whose property is being considered for annexation a voice to accept or reject the proposal by the city to have their land become part of the city.
The process H845 enacts is a Petition to Reject the annexation and stop it in its tracks.
The city could not consider the area again for three years.

H845 will require a one year wait period between putting an area under consideration for annexation before the city could proceed with a Resolution of Intent. Property owners would be given earlier notice than they currently get under existing law. They would be notified when a Resolution of Consideration is passed rather than allowing the city to wait until the Resolution of Intent is passed. 

H845 also provides a way for the property owners to avoid the often financially devastating costs caused by the installation of water and sewer utilities into the area as a result of the city proposing the annexation. The city will now have to consider the possibility of footing the bill for all the water and sewer infrastructure.

H845 will also require municipalities who do not carefully follow the annexation laws to pay the costs of any resulting appeal to the court of an annexation that is not rejected.

The people finally have a very good piece of legislation moving through the State Legislature after all these years of asking for REAL reform of the annexation laws.
This is legislation that delivers justice and fairness to those to whom justice has been denied for half a century.

House Bill 236 – Biltmore Lake Annexation Repeal passed the House Finance Committee and will be heard on the

House Floor Monday evening March 28, 2011!

 This, along with other annexation reform legislation, is long overdue.  Voters across our state have been patiently waiting for reforms of NC statutes regarding annexation.   A soon to be introduced Annexation Reform Bill will hopefully address the many inadequacies of the present law.  Nonetheless, in the interim, repealing the aggressive overreach of Asheville against its County neighbors is necessary.  

 Please support H236 - Biltmore Lake Annexation Repealed and let’s start the process on real annexation reform.  The time has come to move forward on this matter of importance to our citizens.

 Biltmore Lake Annexation Update

 Apparently some senators in the NC Senate are getting "cold feet" pertaining to the local bills on forced annexation.  (For example -- as in our case -- the local bills Tim Moffitt has sponsored:  a) to repeal the forced annexation of Biltmore Lake Community and 2) a moratorium on forced annexation in Buncombe County.)  

They are called "local bills" because they pertain to a specific locality.  There are several other local bills that would protect other local areas across North Carolina who also face an aggressive municipality.

The gist of the message contained below is that we need to urge the Senators to "put the local bills on the calendar in regular committees for passage."   Also, we are being asked to find out if the senator supports the local bills or not, and report that information back.

Please take some time to make some phone calls or write some letters to the senators listed below.  Most effective ways to contact legislators:  1) personal scheduled visit, 2) letter via regular mail, 3) phone call, 4) email.

Let's let Raleigh hear another round of voices from the mountains!

It has been pointed out this newsletter, at first distribution, did not specifically state the urgent action needed. While we mention below there is an acceptable plan for S27 (Moratorium) in the House, the Senate needs to be urged to consider the LOCAL bills in order that those communities under the gun right now are protected. Please urge the Senate to put the bills on the calendar in regular committees for passage. Ask the Senator if he/she supports the local bills and report that information back to us please.

hings are happening every day at the General Assembly in Raleigh. The House has placed SB 27, the “Moratorium” bill, in the House Rules Committee, which for years has been a graveyard where bills go to die. On the Senate side, word is that there is no enthusiasm on the part of the Republican majority for the recently received House local bills. 

Last night, Tony Tetterton, FAC Vice President, attended a dinner in Nash County where Speaker of the House Thom Tillis addressed the gathering. The Speaker clarified the plan for SB 27, which is to hold it in Rules until April 1 and if the League of Municipalities has not “signed on” to the reform bill by that date, SB 27 would pass the House in rapid fashion. The intent obviously is to not have to worry about a veto proof majority for the reform bill. The Speaker is very aware of the situation of those communities currently undergoing annexation, and this is why their local bills are moving through the House. But the bills apparently face an uphill battle in the Senate.

For years now we have been sending out newsletters. Many of you have acted when asked. Some have not but NOW is the time for all of us to pick up the phones, get on the computer to write our Senators, or better yet, see them in person. Please do SOMETHING. 

The new Senate majority must hear from us. The Senate decision to act will likely be made behind the scenes during normal Senate Republican caucus meetings. Call, write and visit BEFORE that meeting. Use what follows as your guide: (If calling or visiting, please remember the legislatures week is Monday through Thursday lunch.) 

·         The Senate is sitting on House passed local bills that would bring relief to victims of abusive cities.

o        “Local bills” are important because they do NOT have to be signed by the Governor. 

·         Here are the excuses we've heard:

o        If we approve one, where will it stop? (This is the one thing that scares the Senators the most)

            We ask, is there really a time limit on justice and doesn't this sound like they are willing to turn a blind eye to an injustice?

o        It would be "meddling" in local affairs.

               We say: Didn't the General Assembly give the cities the power to annex in the first place? Didn't they abuse it? (Unequivocally, YES)

o        Let the courts decide.

            This is almost laughable; the citizens go into court with a gagged mouth and the judges are required to wear blinders. A NC Supreme Court Justice even said “…there is no room for judicial construction” and “Plaintiffs’ remedy lies with the General Assembly.” In other words, only the General Assembly can help us.

·         The powerful lobbying arm of the League of Municipalities has thwarted annexation reform for too long and continues to be defiant, continuing to pretend to respond to citizens’ “legitimate concerns” with their 20 “changes.” Why is the League now given consideration when it wants to play by outdated rules and remains inflexible?

·         Victims of forced annexation have had NO local representation; we cannot vote for city officials that would impose their laws, previous debt, and taxes on us. This is why we have sought relief from the General Assembly

·         The current legislature gained power by an overwhelming concern of citizens worried about government running amok. Forcedannexation in North Carolina is running amok. It is time for THIS legislature to fix this.

Biltmore Lake Annexation Update 

A little news:

Today Rep. Tim Moffitt filed House Bill 236 - Biltmore Lake Annexation Repealed.

This bill is similar to H5 Kinston Annexation Repealed and H37 Lexington Annexation Repealed bills that passed the House yesterday and will be sent to the Senate.  Providing they pass the Senate, these two bills will become law without Governor Perdue's signature.  BTW, both local Buncombe Reps. Keever and Fisher voted NO to the Kinston and Lexingtonrepeal bills.

H236 presumably will experience opposition from Asheville, the League of Municipalities as well as Rep. Fisher and possibly Rep. Keever.  We'll have to see how it plays out.  Rep.Keever has, however, promised she will vote YES for a moratorium

In other annexation news, Senate Bill 27 - Involuntary Annexation Moratorium passed the Senate yesterday on a 38-11 vote.  Both local Senators Apodaca and Nesbitt voted YES.  This bill is on its way to the House now.  It would be a nice gesture to send a Thank You note to Rep. Moffitt as well as Senators Apodaca and Nesbitt.

There has been some rapid movement in both the Senate and the House on various annexation bills. 

We need to really work hard to keep the momentum going. 

First the Senate: There has been good movement on SB 27, the Moratorium Bill. I expect it to be voted upon on the floor on Thursday and moved to the House side very soon. 

You should be aware that the position the NCLM has taken is to forego the Moratorium Bill and move directly to the Annexation Reform bill. It is obvious the League wants to rush through a reform bill to keep any changes to a minimum. They have touted their "Twenty Points", which really should be called "Twenty Tweaks."  

It is obvious the General Assembly needs to pass the Moratorium Bill as soon as possible, so work can continue on the Annexation Reform bill -- a bill which would encompass realreform, and which would not allow the decades of abuse to continue. 

Second the House: So, I am asking that you write, call, visit, and e-mail Speaker of the House Thom Tillis to let him know your feelings about the Moratorium Bill. Be sure to thank him for his support of the various local bills he has allowed be heard, but stress the importance of quick action on the Moratorium BIll.

Numerous local bills are in various stages of activity in the House. "HB 5 Kinston Annexation Repealed," and "HB 37 Lexington Annexations Repealed" have both passed their third reading and are on their way to the Senate this week. "HB 56, Rocky Mount Annexations Repealed," "HB 180 Wilmington Annexation Suspension," "HB196 for Goldsboro Deannexation," are in line to be heard in the House Government Committee. In addition, Rep William Brisson will introduce a local bill in a day or so to throw out Wilmington's annexation of Monkey Junction.  

Here is a potential problem: I have heard that some Senators are not "hot" on these local bills. The words I have heard are "We should not be meddling in municipality business." 

First, the General Assembly is the body that incorporates each city. Second, the General Assembly has delegated the authority to annex to the city, but has always retained the right to annex or de-annex. Ultimate responsibility for annexation rests with the General Assembly. One only has to look at the number of "local" bills introduced each year to shoot large holes in the theory that the General Assembly is "meddling" in the city's business. 

And, why the bills to stop ongoing annexations, or in Goldsboro's case, to deannex? 

The answer is simple really: Justice. Or, if you prefer, Equity

There has been neither justice nor equity for the annexed citizen under the current law. If you think there has been justice, please show me where. In the courts? Nope. The courts are limited to reviewing three procedural items only. The courts have demonstrated to we citizens time and again that their hands are tied, and have told us, if we want justice, then our avenue should be with the legislature.  

And as far as the plight of those cities who "have done it right and in good faith," well, I am sorry about that. My concern is with the citizen who has "done it right and in good faith" and who has gotten screwed every time. 

To those elected officials who are concerned with all the above, my final thought is that the Constitution of the State of North Carolina, Article One (Bill of Rights) Section Two, says,"All political power is vested in and derived from the people; all government of right originates from the people, is founded upon their will only, and is instituted solely for the good of the whole." 

I see nothing in this Article about "all power resting in the cities", nor "any government of right originating with the cities." 

Let all fifty Senators know they have a chance to, for once, provide justice to the people of North Carolina, and we expect them to do so

Biltmore Lake Annexation Update

 

Very Important!  Here's the latest news about Senate Bill 27 - Involuntary Annexation Moratorium Bill.  Please help by sending your emails to these senators.  Ask them to act on this bill now and to pass SB 27 without change.

Senate Bill 27, Annexation Reform, has been sent to Finance for consideration. It is not on this Committee's Tuesday calendar, but it may be there on Wednesday.

 

When it was voted out of the Senate State and Local Government Committee last week to the Finance Committee, two League of Municipality lobbyists were seen giving each other "thumbs up" signals.

 

One of the Co-Chairs of the Finance Committee is Senator Fletcher Hartsell (R) who, though a co-sponsor of this bill, made a comment in the State and Local Government Committee to the effect that those cities currently undergoing annexations should be excluded from this moratorium.

Senator Harris Blake (R), agreed with the thrust of Senator Hartsell's comment. We need to ensure that these Senators know how strongly we feel about this bill moving to the Senate floor for a vote.

 

Perhaps I am putting two and two together and getting five, but this concerns me.

Please write to each member of the Senate Finance Committee at the e-mail addresses listed below and urge them to:

 

1. Take up Senate Bill 27 now.

2. Pass it without change.

 

Please remain polite in your correspondence. You can be firm but remain polite in getting your ideas across. Thank them for their support for REAL annexation reform.

No action occurred Wed or Thurs 2/16-17/2011 regarding Senate Bill 27 - Involuntary Annexation Moratorium Schedules were adjusted to allow different work and to attend Governor Perdue’s budget presentation.  It is projected further activity on the annexation moratorium will happen this coming week.  That gives all who didn’t have the time to email the Finance Committee Senators this week additional opportunity to do so before they vote on Senate Bill 27 – Involuntary Annexation Moratorium next week.  See links for the Finance Committee Senators below:

On Tuesday, the Senate State and Local Government Committee passed SB 27, Annexation Moratorium, out of Committee. It was sent to Senate Finance on Wednesday and will likely be heard in committee next week.

The room was packed with Red Shirts, and two of them made short, eloquent statements. Kent Dozier, already annexed against his will by Rocky Mount, described the services he has received for city taxes, which included a tax on water run off from his house. The list was a short one (garbage.) Thanks Kent!

Then Tony Tetterton, FAC Vice President, shared with the Senators the comparative research he has done between Virginia and North Carolina, since the League of Municipalities had implied NC was a better state due to our forced annexation law in comparison to Virginia's 23 year old moratorium on annexation. These facts were very convincing for making Tony's case. The League even asked for a copy after the meeting.

Thanks to everyone who made it to this fairly short meeting. I know many Red Shirts have emailed me expressing their regret that their schedules were already set -- not to worry, as there will be many more opportunities, believe me. We will do our best to keep you posted on the progress of the various bills in the House and Senate.

After Governor Perdue's State of the State speech on Monday, the Republicans gave their response. Here is what Senator Berger, President Pro Tem, said about annexation: "To help you protect your property rights, we will pass a moratorium on forced annexations."(Video)

The press has been full of annexation stories lately -- Asheville to Wilmington. Don't let these editors get by with repeating the League mantras. I have read some wonderful responses. Keep it up.

Other organizations around the state have been very involved in the push for Annexation Reform: The John Locke Foundation, FreedomWorks, and Americans For Prosperity were all at the Senate Committee meeting yesterday.

Senate Bill 27 - Annexation Moratorium  vote will be called this week.  

*** The State and Local Government Committee discussed the Bill last week but did not vote on it.   This Committee will be meeting this Tuesday, February 15th, @ 12 noon in Room 1124, Legislative Building on Jones St., Raleigh to vote on the Senate Moratorium Bill. 

If you can, take time to attend this meeting to show citizen support. Your presence will be very helpful to counter the lobbying of the League of Municipalities.  The passage of this bill will be a ‘bell-ringer’ for annexation reform.

Call a friend, ask a neighbor, or enjoy some quiet time during your drive to Raleigh; whatever suits you, but DO make special effort to help.  Wear your RED SHIRT.

 

Ladies and gentlemen, legislators need your support!  It is clearly time for all of us to get off the backsides to help get the law changed.  This moratorium bill, if passed, will give House Representatives and Senators time to work through the often messy legislative process.  50 years is a long time for anything but overhaul of an out-dated law that continues to affect countless lives throughout North Carolina is long, long overdue.  It's not going to be an easy battle and there are going to be a few twists & turns, strong lobbying and "stories" told but we have come so far -- now is not the time to let up. 

 

No doubt the North Carolina League of Municipalities will be weighing in on this situation.  The League's office is two blocks away from the Legislative Office Building and their horde-of-lobbyists will be "button-holing" every House Representative and Senator providing ream after ream of "evidence" why changing the annexation law will cause irreparable harm to North Carolina.  Never mind the fact North Carolina is one of only a handful (4-5 states) that employs FORCED ANNEXATION without a say in the matter.  All other states allow or demand their citizens, affected by annexation, be allowed to cast their vote on the matter -- not North Carolina.  Here a founding principle of Liberty – a VOTE is long overdue.  You are being given the chance help bring about change.  Below are names and contact information for our area representatives, Legislative leaders and Gov. Perdue.  Call and write them now.

2 AN ACT TO ADOPT A MORATORIUM ON INVOLUNTARY ANNEXATIONS.

3 The General Assembly of North Carolina enacts:

4 SECTION 1. No resolution of consideration, resolution of intent, or annexation

5 ordinance may be adopted under Part 2 or 3 of Article 4A of Chapter 160A of the General

6 Statutes from the date this act becomes law until July 1, 2012. If any annexation proceeding has

7 been initiated under those Parts prior to the date this act becomes effective but the annexation

8 ordinance has not yet been adopted, any provision of law requiring any action or notice by the

9 municipality or any person within a certain period of time is tolled during the suspension of

10 authority provided by this section. Nothing in this section shall prohibit municipalities from

11 developing policies, planning, collecting data, or developing materials with respect to potential

12 future annexations under Part 2 or 3 of Article 4A of Chapter 160A of the General Statutes.

13 SECTION 2. An annexation ordinance adopted under Part 2 or 3 of Article 4A of

14 Chapter 160A of the General Statutes that has an effective date on or after the day this act

15 becomes law shall not become effective until July 1, 2012, unless the municipality by

16 ordinance adopts a new effective date later than July 1, 2012, for the annexation ordinance. An

17 annexation ordinance that was adopted under Part 2 or 3 of Article 4A of Chapter 160A of the

18 General Statutes prior to the effective date of this act and is the subject of litigation in any court

19 on the effective date of this act shall not become effective until after July 1, 2012, unless the

20 municipality by ordinance adopts a new effective date later than July 1, 2012, for the

21 annexation ordinance.

22 SECTION 3. Any litigation pending in any court of this State shall be stayed upon

23 enactment.

24 SECTION 4. If any municipality has adopted its budget ordinance for the

25 2010-2011 fiscal year prior to the date this act becomes effective and the total amount of

26 assessed valuation estimated in that budget ordinance has been reduced because of this act, the

27 municipality may amend the budget ordinance to account for this act including establishment of

28 a different tax rate.

29 SECTION 5. If any provision of this act or its application is held invalid, the

30 invalidity does not affect other provisions or applications of this act that can be given effect

31 without the invalid provisions or application, and to this end the provisions of this act are

32 severable.

33 SECTION 6. This act is effective when it becomes law and expires on June 30,

34 2012.

Biltmore Lake Annexation Update 

Annexation reform is required to level-the-playing-field so everyone has a say in the matter and ‘it’ will be coming to-a-head during this legislative session. 

The BLCAC Steering Group has been telling you about the show-down a ‘brewing and now we need your help.  In addition to emails, letters and calls to our local representatives, we absolutely need residents to set aside their daily plans and go en mass to Raleigh on WEDNESDAY, FEB 02, 2011 to demonstrate our resolve to see annexation reform happen.  [Please note -- addresses can be found on our web site at www.stopasheville.com/state.htm,  or here http://www.ncga.state.nc.us/gascripts/counties/counties.pl?County=Buncombe.]

One should plan to arrive mid-morning (10:00 AM), perhaps visit with local representatives, have lunch in the cafeteria, observe floor proceeding from the gallery and expect to depart mid to late afternoon.  And, of course, wear RED A few hundred red shirts really stand out among all the blue business suits.

Why all the show and glow?  Because, the North Carolina League of Municipalities (NCLM) lobby has come-out-swinging against serious annexation reform (see FAC bulletin below).  They are dead set against annexation reform that would take away power of municipalities to force people to pay City Taxes. Fortunately, in this new General Assembly, there are many representatives in both chambers who are just as serious and plan to enact honest reform.  In fact, soon after the session begins, an Annexation Moratorium Bill will be filed.  These representatives will be working to enact reform but they need to see there is citizen (voter) support for annexation reform too.  This is where you come in – we can’t just sit on the sidelines and let the other guy do it.

For your review, we offer the recent bulletin from the Fair Annexation Coalition [FAC].  

The number one reason for this message is to pre-alert you to a scheduled Red Shirt visitation day at the General Assembly on Wednesday Feb 2, 2011. 

The idea is that our new Legislature will have had one week under their belts and the anticipated Moratorium Bill will have been filed. (By the way, I have been advised this bill will include annexations not yet finalized -- i.e. still in the courts -- as well as put a hold on any future annexations while the current law gets revised.) 

Look for more specifics on this Red Shirt visit to follow as we get closer. For now, please mark your calendars for  WEDNESDAY, FEB 2, 2011. We plan on visiting both the House and the Senate members. I will have some simple handouts for you to use if you desire. Plan on a mid morning arrival and visits, lunch in the cafeteria (in your red shirts of course), and then up in the galleries when the session starts. We don't have a specific session start time as yet, but it will almost certainly be in the afternoon. 

We have come too far not to press ahead and change this abusive law. Please plan to join us on  Wednesday, Feb 2, 2011in Raleigh.

Other annexation news: 

1. NCLM Reporting: The NCLM took great glee in reproducing on their website a DISPATCH article concerning the NC Court of Appeals ruling on the Davidson County annexation case: 

Annexation ruling is a gut-punch to opponents

The lead horse coming up lame down the backstretch. A 20-knot wind disappearing during the middle of a regatta. A six-run lead in the ninth-inning being compromised with a closer’s shaky curve.

That’s how opponents of the City of Lexington’s forced annexation had to feel when they received word of the N.C. Court of Appeals’ 25-page ruling that unanimously ruled in favor of the municipality and its 2008 decision to annex three areas around its borders.

After more than a year of anticipation, the appellate court finally dealt the nearly fatal blow to the Citizens United Against Forced Annexation. Although the group can still appeal the court of appeals’ ruling to the N.C. Supreme Court, the state’s highest bench isn’t forced to hear the case and only chooses to hear a fraction of the cases that aren’t unanimous decisions. The opponents have 35 days to make a decision on whether to seek the state’s highest court for a final decision. 

Let's just wait and see how much glee there will be in the League Headquarters next year at this time.

4. Another case on Appeal: Annexation opponents across the state are flooding the court system with annexation cases. Gates Four, which has been fighting Fayetteville since the "Big Bang" annexation, has filed for a rehearing before the NC Court of Appeals.  LATE BREAKING: The appeals court has refused to reconsider the case...now onto a NC Supreme Court appeal. ReadHERE. They have additional appeals lined up.  

Do you recall my mentioning that it will be 2024 before some neighborhoods in Fayetteville receive their sewer service?  Never mind the law requires that the sewer mains were to have been in by 2007. Our new annexation law must keep this from happening ever again.  

Fayetteville's attempt to annex Gates Four is nothing but another tax grab, as this community already has all the services it needs, wants, or requires. According to city estimates, Fayetteville will net $2.6 Million over five years from annexing Gates Four.

BILTMORE LAKE ANNEXATION UPDATE 

As we enter 2011, the steering committee felt it timely to update you on our case and other related events.

Regarding our lawsuit against Asheville, our attorney has been pulling together all the necessary material and exhibits for the record of appeal and filing same with the clerk of the Court of Appeals.   After 60 days (early March) we should learn when our case will be on their calendar.

The Fair Annexation Coalition (FAC) group has been developing a strategy regarding annexation reform to bring to the new legislature in Raleigh.  Since the recent election, we find that we have more receptive and sympathetic ears in the new assembly.  While this is a most welcome turn of events, it would be unrealistic to expect that everything on our agenda will be easy to enact.  Rest assured that the opposition (League of Municipalities) is working overtime to ingratiate themselves with the new leadership and players in Raleigh.  It would be naïve to think that all necessary reforms are a slam dunk, but our prospects to make headway look more promising than they have in decades.

The end of 2010 brought our treasury additional and unsolicited funds from residents.  We would like to think that as some of you were writing checks for your real estate taxes at year end, you were reminded of the significant savings you have enjoyed the past four plus years due to our efforts.   We thank those of you that have stepped up in this fashion, and if any others feel so motivated by this example, our treasury is always open for contributions.  It will make our job that much easier down the road when we need to raise additional funds to see this through the final stages of the appeal process. 

We anticipate a number of annexation reform bills will be introduced during the first few weeks of this legislative session.  How long it may take to get anything passed and what it will look like is anyone’s guess, but we will keep you advised as matters progress on all fronts.  Finally, feel free to contact our representative, senator, and the leadership in Raleigh on the need to take advantage of this opportunity to bring about long overdue reform to the annexation statutes.

Biltmore Lake Annexation Update

 As 2010 draws to an end, a short review is in order as well as a quick look-ahead.

What happened -- what to expect:

  • 3 full years - NO Asheville property taxes – minimum $3600+ savings.
  • Biltmore Lake annexation lawsuit – Appeals hearing of Superior Court ruling not expected until March 2011 at the earliest.
  • November 2010 elections ushered in new NC legislative leadership (to be confirmed Jan. 2011) – important as more supportive of annexation reform: 
    • Senator Phil Berger (R) - Senate President Pro Tempore
    • Senator Harry Brown (R) - Senate Majority Leader
    • Senator Tom Apodaca (R) - Chairman of Rules & Operations Committee
    • House Representative Tom Tillis (R) - Speaker of the House
    • House Representative Paul Stam (R) - House Majority Leader
    • House Representative Tim Moffitt (R) - District 115 (includes BL) newly elected representative who fought Asheville annexation of Royal Pines.
  • 2011 NC General Assembly begins on Wednesday, January 26, 2011.
  • Annexation reform bills expected to be introduced within the first two weeks of the new session – when that happens, Red Shirt proponents are called upon to go to Raleigh to demonstrate support.
  • A new bill calling for a Moratorium on annexation is expected – to include legally pending annexations.

It’s encouraging to see the realignment of the NC representatives supportive of annexation reform and important to recognize the great-distance the citizens of North Carolina have come as we get closer to actual reform.   

However, it is important to also realize the North Carolina League of Municipalities will again engage an all-out campaign to block annexation reform.  The League gains additional financial support via increased membership fees as municipalities grow through forced annexation.  Accordingly, the League encourages cities to expand their land area and population via forced annexation. The League employs lobbyists whose job it is to pressure legislators to vote against annexation reform.

Grass-root citizen actions have already made a big difference combating the League’s efforts.  Continued action will help change a bad law.  Sending emails, letters, or phone calls to NC representatives is important.  Your help is critical.  We’ll call upon you when that help is most appropriate and we’ll keep you informed regarding the timing for that action.

Biltmore Lake Annexation Update 

Annexation reform should not be a partisan issue.  Nevertheless, you will recall former Democratic Senator Tony Rand (retired) and former Buncombe County Democratic Senate Majority Leader Martin Nesbitt the past two years stymied Senate hearings on annexation reform bills.  That situation should change with recently elected representatives and the projected new-leaders of the NC legislature.  

When you get to the bottom line, citizens confronted with forced annexation don’t care what party affiliate a legislator is.  They [WE] simply want them to honestly work to level the playing field so those being forced into a municipality are afforded a say in that transaction.  However, it appears, based upon the recent changes in the North Carolina legislature, a much better chance for annexation reform seems possible.  

For your review, we offer the recent notice from the Fair Annexation Coalition [FAC].  A link to the North Carolina Board of Elections provides significant information about this election.  Of the 6.2 millionNorth Carolina registered voters, only 43% [2.7 million] actually went to the polls.  And here in Buncombe County, approximately 80 thousand of the 176 thousand registered voters [45%] showed up to vote.  

ANNEXATION REFORM is not a dead issue in North Carolina!

Regardless of whether you are a Republican, Democrat, Libertarian, or Independent, if you are in favor of annexation law reform, Tuesday's North Carolina election has got to have your heart pumping a little quicker. These overwhelming results mean we will finally fix NC's abusive forced annexation law.

The Republicans will control both the Senate and the House in the General Assembly. As I write this, it looks like the Senate will be 30-20 and the House 68-52, which are HUGE gains for the Republicans.

Across the state, supporters of annexation reform won. Those who have been among the many roadblocks to reform lost, or in one case are in danger of losing.

Congratulations to Rayne Brown, who defeated the former House Majority Leader Hugh Holliman by 58% to 42%. A huge win for Citizens United Against Forced Annexation (CUAFA) in Davidson County but even more so for the entire state's annexation reformers!

In addition, Stephen LaRoque had a huge win defeating incumbent Van Braxton 57% to 43%. Mr. LaRoque, from the beginning of his campaign, has had annexation reform as one of the key points of his platform.

Lewis Pate, former House member, won election from Wayne County in the Senate, defeating incumbent Don Davis.

Buck Newton, strongly supported by Oak Level Citizens Against Forced Annexation (OLCAFA) due to his support for annexation reform, defeated incumbent AB Swindell.

Ralph Hise defeated incumbent Senator Joe Sam Queen, Wesley Meredith defeated Senator Margaret Dickson, and Rick Gunn defeated Senator Tony Foriest.

As I write this, Rick Glazier, one of the strongest supporters of the NC League of Municipalities and one of the prominent leaders of the House Democrats, is winning by 24 votes. Watch this one.

Other incumbents, strong annexation reform supporters, won their elections: Phil Berger, Skip Stam, Thom Tillis, Larry Brown, Nelson Dollar, Fred Steen, Carolyn Justice, Pat Hurley, Dale Folwell, Harris Blake, and Jamie Boles all won -- several were unopposed.

We at the Fair Annexation Coalition pledge to do all we can to assist the new leadership in crafting and passing MEANINGFUL ANNEXATION REFORM. We know that we cannot match the resources of the NC League of Municipalities, but we feel that the voters of North Carolina have sent the strongest possible signal to both Republicans and Democrats, and we hope (perhaps foolishly) that the League sees these results in the same way.

FORCED ANNEXATION AND THE CANDIDATES 

As you go to the polls November 2 (or in early voting which starts October 14), please consider how those on the ballot feel about forced annexation.  While it isn’t the only issue to consider, it is an important one.   

We have scoured websites and contacted all the candidates for their views on forced annexation.  Here is the list of all those who have stated they support reform of the current annexation law, including a binding referendum of residents targeted for annexation:

Most of the other candidates on the ballot don’t impact forced annexation. Hi everyone! 

Hope you've had a great summer.  Unfortunately the NC General Assembly met and left with no change in the forced annexation law, which means that we still have our work cut out for us.  

On Monday we have an opportunity to show our displeasure of forced annexation, and at the same time show our support for the people of Buncombe County who live in the Royal Pines and Cooper's Hawk Drive areas.  These two areas are under attack by the City of Asheville with their intent to strong-arm the property owners into the city limits.  There is strong opposition from the folks, and in an effort to demonstrate to the larger community that we don't like forced annexation anywhere, we are holding a rally and protest.  This will coincide with the public information meeting conducted by the Asheville City Council. 

Please come on over for a short time.  You can make a big impact!  If you remember how you felt about being assaulted by forced annexation, just think how nice it would have been to have had other residents of the county standing in solidarity with you.  The more we can have public exposure like this, the more the state government will feel pressure to change the law, and local governments will feel the pressure of unpopularity, especially at election time. 

Here are the details: Monday, September 13, 4:45 – 6:15 PM, Public Works Building, 161 S. Charlotte St.  This is a VERY visible location with lots of room on both sides of the street for people to congregate and wave signs.  And it's during rush hour.  We could get some good media coverage.   

Wear red!  Bring a homemade sign.

 A word about parking: we'd like to leave the close parking spaces open so the people from Royal Pines and Cooper's Hawk Drive can find a place near the building.  A large parking lot is on the corner of South Charlotte and Davidson Streets, so finding a spot shouldn't be difficult.  Come early if you can!

This is an important legislative effort and needs our support!  Annexation reform supporter Senator Larry Shaw has asked Senate Majority Leader Senator Martin Nesbitt [BuncombeCounty] to speak with Senate President Marc Basnight asking for support for Senate Bill 494 [S494] to be heard by the full Senate.  Senator Shaw’s bill is truly a positive annexation reform bill and deserves our help.  Please call Senator Nesbitt and encourage him to get behind this effort.  Reform organizations across the state are supporting this effort and you can help too; you can call Senator Nesbitt’s office at these numbers:  (919) 715-3001 in Raleigh and (828) 252-0490 in Asheville.  Ask Sen. Nesbitt and Sen.
